If a lessor has benefited from a different type of tenancy agreement, he must communicate these information to his tenant: for a short-term tenancy agreement, an inscription (AT5) must be served before the start of the lease and the tenant only has a limited rental guarantee. The lessor may apply for ownership of the premises for a number of reasons defined in the Housing (Scotland) Act of 1988 and after the end of the agreement (date “ish”). The minimum duration of the initial saT rent is six months. If the initial term is less than six months or if an AT5 is not served before the lease, it will effectively be a guaranteed lease, regardless of the securities. Excluded properties include stores, licensed premises, farms, vacation homeowners or resident owners. Examples: tenant violated a term of the tenancy agreement; acted in antisocial behavior or the owner`s HMO licence was withdrawn. The tenancy system defines the legal agreement between the tenant and the lessor and is an important part of ensuring that the private rental sector is functioning properly.

If your landlord dies or changes, the new owner will have to comply with the terms of your rental agreement. They must follow the correct procedure if they want to terminate the lease, see the section on evacuation for more information. For example, your lease could stipulate that “the property is leased for a period of six months, then monthly.” This would mean that your lease would last six months and it could then be renewed one month at a time. The lessor must also inform the prospective tenant or tenants that the lease offered is a short-term award contract under Section 32 of the Housing (Scotland) Act 1988 before signing the contract itself.
